§1 Scope of application 

(1) The following GTC (General Terms and Conditions) apply to all orders placed by consumers via our online shop. 

(2) For the purposes of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or self-employed professional activity.

(3) If an entrepreneur uses conflicting or supplementary GTC, their validity is hereby objected to.


§2 Conclusion of contract

(1) The purchase contract is concluded with deadball.eu.

(2) By placing the products in the online shop, we make a binding offer to conclude a contract for these articles. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided for this purpose in the order process.

(3) An order is only possible if all mandatory fields marked with * in the order form are filled in. If any information is missing, or if we are unable to process the order for any other reason, the customer will receive an error message. 

(4) The contract is concluded by accepting the offer for the goods contained in the shopping cart by clicking the order button. As soon as the order process has been completed, the customer will be notified of this with the info window "Your order has been completed and has been successfully sent to us". 

(5) Immediately after sending the order, you will receive another confirmation by e-mail.

 

§3 Contract language, contract text storage

(1) The language available for the conclusion of the contract is English.

(2) We store the text of the contract and send you the order data, our GTC and our cancellation policy by e-mail. You can also view the current GTC at any time on our website. You can view your past orders in our customer area under My Account -> My Orders.


§4 Delivery restrictions

(1) The online-shop is intended for the member states of the European Union, the United Kingdom and Switzerland.


§5 Price and terms of payment 

(1) All prices are total prices. They are inclusive of all taxes (including VAT) but excluding shipping costs. 

(2) The shipping costs can be found in our shipping policy.

(3) In case of delivery to a non-EEA country (European Economic Area, includes the member states of the European Union, furthermore Iceland, Liechtenstein and Norway) the consumer has to bear all import and export charges including applicable customs duties, fees and charges. 

(4) At the time of conclusion of the contract, the purchase price is due with immediate effect. If the customer fails to fulfil his payment obligations, reverses or suspends payments or if other circumstances become known which call the customer's creditworthiness into question, we are entitled to cancel the order and thus to reverse the purchase.

 

§6 Payment methods

We accept the following payment methods: 

(1) Credit card (through Shopify-Payments)

When submitting your order, you simultaneously transmit your credit card details to us. After your legitimation as a legitimate cardholder, we request your credit card company to initiate the payment transaction immediately after the order. The payment transaction will be carried out automatically by the credit card company and your card will be charged. 

 (2) PayPal, PayPal Express

In the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

 (3) Apple Pay or Google Pay (through Shopify Payments)

When paying with Apple Pay or Google Pay, you will be redirected to the website of the provider Apple Pay or Google Pay during the ordering process. In order to pay the invoice amount via Apple Pay or Google Pay, you must be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we will request Apple Pay or Google Pay to initiate the payment transaction. You will receive further instructions during the ordering process. The payment transaction will be carried out automatically by Apple Pay or Google Pay immediately afterwards.

 (4) IDEAL (through Shopify Payments)

Available for customers from the Netherlands

(5) EPS - Überweisung (through Shopify Payments)  

Available for customers from Austria

(6) Bancontact (through Shopify Payments)

(7) Klarna (buy on account), (through Shopify Payments)

§7 Delivery and shipping conditions 

(1) Free shipping within the EU for purchases over 30€!

(2) Shipping costs are added to the stated product prices. You can find out more about the shipping costs during the ordering process or by clicking here. 

(3) In the case of delivery to a non-EEA country (European Economic Area, includes the member states of the European Union, as well as Iceland, Liechtenstein and Norway), the consumer must bear all import and export charges, including any applicable customs duties, fees and charges. 

(4) The dispatch of the purchased goods shall generally take place within the periods specified under dispatch after order confirmation. Outside of our control, in special cases, the shipping service provider may cause delays in the delivery chain, which may result in an extended delivery time. 

(5) We only deliver by dispatch. Unfortunately, it is not possible to collect the goods yourself.

(6) If not all ordered products are in stock, we are entitled to make partial deliveries as far as this is reasonable. Any time limits shall only begin with the receipt of the last partial delivery.

(7) If the package is not successfully delivered to the specified address through the fault of the customer (wrong address, permanent absence at the specified address), the package will be returned to us at the customer's expense. The costs incurred in this process will be deducted from the refund to the customer.

(8) For shipping, we hand over the postal address and, if available, e-mail address to our shipping service provider so that the package can be delivered. In this way, the customer also receives information in advance about the date and time of the delivery from the shipping service provider. This transmission takes place within the framework of the shipping order between us and the shipping service provider for the purpose of delivery and does not require the consent of the recipient. The shipping service provider processes this data exclusively for this purpose and for no other purpose.


§8 Right of withdrawal

(1) The order can be cancelled or the item returned within a period of 30 days after receipt of the delivery.

§9 Warranty, guarantee 

(1) The provisions on the statutory warranty shall apply. The warranty period for the delivery of movable goods is two years from the receipt of the goods. 

(2) Complaints based on statutory warranty claims or other complaints can be made to the following e-mail address:

(3) We do not provide any warranties of our own beyond the statutory warranty.

(4) Technical deviations (in particular differences in the color of the print, different wood grain, different concrete pores) of the delivered goods from the advertised goods are permissible and do not constitute a defect, provided that they are within the customary range and the contractual purpose is not significantly restricted. Color deviations of the artwork may occur if the customer's monitor is calibrated differently and not true to color. Differences in brightness also depend on the setting of the monitor or screen.


§10 Liability, compensation for damages

(1) In the event of a breach of material contractual obligations due to negligence by us, our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. 

(2) Otherwise, any claims for damages shall be excluded.


§11 Copyright

(1) All contents of this website (texts, pictures, layout and design elements, videos) as well as the offered goods are subject to copyright. Any editing, commercial use, distribution, inclusion in other works or publications by print or in electronic media constitutes a copyright infringement. Unauthorised reproduction, even in excerpts, is not permitted and is punishable by law. If necessary, we will legally prosecute the unauthorised use of content on our site.


§12 Dispute resolution
